ZK Results – Jury Trial Defense Verdict for Attorney John W. Zotter
On September 28, 2017, an Allegheny County jury returned a defense verdict in favor of Zimmer Kunz clients represented by Shareholder, John W. Zotter. Plaintiff filed suit against the owner of commercial property and the tenant, a worldwide restaurant chain. Plaintiff alleged that she sustained a closed head injury when she slipped on ice and struck her head on the sidewalk outside of the restaurant. At trial, the Defendants argued that the property was properly maintained and disputed the existence of ice. Because the Plaintiff claimed that she fell as the result of an isolated patch of ice, the Court refused to charge the jury on the Pennsylvania “Hills and Ridges” doctrine. Following a fifteen minute deliberation, the jury returned a unanimous verdict in favor of the Defendants finding that the Defendants were not negligent.
