ZK Results – Attorney Jeff Ramaley receives verdict in favor of insurance company client
On July 11, 2017 shareholder Jeff Ramaley received a non-jury verdict from the Court of Common Pleas of Allegheny County, Pennsylvania in favor of an automobile insurance carrier he represented and against an insured in a dispute as to whether a waiver of UIM coverage was valid. The insured argued that the waiver was invalid because it did not contain a policy number so that it could be determined to which policy the waiver applied. Mr. Ramaley argued on behalf of the carrier that the PA waiver statute dictates what should be on the waiver form, that the insurer followed the form, and that the Legislature did not direct the carrier to include a policy number. Also, the parties entered a stipulation as to what documents the insured signed and that his signature appeared on the form. The insurer therefore argued that there could be no question as to which policy the waiver form applied.
