In one of the largest toxic chemical spills in West Virginia history, we successfully defended the company that maintained the railcar involved in the spill. Following a two week jury trial seeking over $21 million in indemnity and contribution claims against our client, the jury found our client only 10% liable precluding recovery under West Virginia’s comparative negligence statute and limited our client’s exposure to 10% under the contractual indemnity claim, an amount substantially less than the pre-trial offer.Back to all practice areas
