Attorneys of Zimmer Kunz represent companies and their insurers in tens of thousands of asbestos and silica matters. We have over 30 years of experience in managing this litigation and presently serve as national coordinating counsel for a manufacturing client. We represent 15-20 clients directly in Pennsylvania, West Virginia, Ohio and New York and through local counsel relationships in Michigan, Kentucky, Texas, Indiana and Mississippi. We have tried cases to verdict and been involved in global settlements involving thousands of cases at a time.
In addition to asbestos and silica defense work we have handled cases involving solvents (styrene, MEK, benzene), Isocyanates (HDI, TDI and MDI), mold claims, lead paint claims, latex glove claims, formaldehyde claims, sick building syndrome, multiple chemical sensitivity, PCB exposure and product warning cases.
In one of the largest toxic chemical spills in West Virginia history, we successfully defended the company that maintained the railcar involved in the spill. Following a two week jury trial seeking over $21 million in indemnity and contribution claims against our client, the jury found our client only 10% liable precluding recovery under West Virginia’s comparative negligence statute and limited our client’s exposure to 10% under the contractual indemnity claim, an amount substantially less than the pre-trial offer.
